How the mighty are fallen... Leibovitz sued by photographer

Celebrity photographer Annie Leibovitz is being sued by an Italian photographer who says she used his pictures without permission.

Paolo Pizzetti claims Ms Leibovitz used photos he took in Venice and Rome, and passed them off as her own in a 2009 calendar for a coffee company.

He is seeking a court order to stop the images from being used and $300,000 (£183,000) for copyright infringement.

A spokesperson for Ms Leibovitz declined to comment.

According to legal papers filed at a New York federal court, Mr Pizzetti said Ms Leibovitz, 59, hired him to scout locations in Italy for an advertising campaign for Lavazza coffee in April 2008.

He said he photographed the Trevi Fountain in Rome and Plaza San Marco in Venice as well as other images which he sent to her digitally, but was later informed Ms Leibovitz would not be travelling to Italy for the photo shoot.

Hmm, I'm in two minds about this, if he was hired and sent her images then how can we prove that he was not hired to take the backgrounds and is not just another money hungry wannabe. Guilty of theft, probably not. Guilty of naivety, yes!

As for her other court case, this is particularly sad, the loan was probably taken out to cover the incredibly large inheritance tax on her late partner Susan Sontag's vast estate as their partnership was not recognised by law as a common law marriage.

Its very very sad and I hope the copyright to her images remain with her and she's allowed to continue her work in peace!

I think it would depend on the contract - and would have thought it would be included that those images may be used :-/

Hope it all gets sorted for - I didn't know her partner passed away recently and she had troubles with that either.

Yeah Susan Sontag - incredible photographer, its really sad, I hope she doesn't lose everything, although its not looking hopeful right now, thats a hell of a loan!

I had no idea Susan Sontag was dead!!! :*( that's most upsetting. This whole thing is a bit sad indeed - and my thoughts are with Annie at this time. It does sound like the chap in question is more money hungry wannabe than genuine.

It's not as if Sontag passed away recently either, but I'm rubbish at knowing these things. :/ She was a very inspirational person, without whom I'd never have got one of my degree modules, and a fab photographer also.
