Copyright question

Ok we all know the arguements about copyright but I have a slightly different question.

If a photo has been copied then altered to any degree, who then can lay claim to the copyright? A= the original photographer or B= the person who altered the original photo? as the altered copy is a new work of art.

If it's any help I did some law stuff at uni regarding artwork and I know for a fact that it isn't clear cut - this whole subject is to do with a term known as 'substantial similarity'

I think it remains with the original owner no matter what.

In music for example, you can sample something and make it sound nothing like the original (ie speed up or slow down) but the copyright still remains with the original author, as it's works or derivatives of.

I believe it still belongs to the original owner if there is a "substantial similarity" between the edited version and the orginal.
